Limited Lifetime Warranty

The Warranties set forth below are provided on Simply45® branded products (“Products”) defined below and manufactured by Simply45, LLC, (“Manufacturer”). The Simply45® product line is sold direct and through authorized resellers as determined by the Manufacturer. This limited warranty gives you specific legal rights, and you may also have other rights which vary from country to country and state to state.

Subject to the provisions herein, Manufacturer warrants to the original purchasing Customer from the initial date of purchase a Limited Lifetime Warranty free from defects in materials or workmanship when purchased in new condition in its original packaging from an authorized reseller or direct from Simply45® or GoSimplyConnect™ on the following Products:

Simply45® branded RJ45 modular plugs for both pass-through and standard WE/SS type – Includes parts:

Simply45® branded RJ45 Strain Reliefs – Includes parts:

Simply45® branded and registered RJ45 crimp tools for both pass-through and standard RJ45 modular plugs – Includes parts:

Simply45® branded patch panels and keystones – Includes parts:

All other Products when purchased by you and delivered to you in new condition in their original packaging warranted against defects in materials or workmanship for a period of 2 years after the initial date of purchase from an authorized reseller or direct from Simply45® or GoSimplyConnect® on behalf of Manufacturer.

Within 30 days of the Manufacturer’s receipt of a defective Product which is determined by the Manufacturer’s sole discretion to be defective upon inspection, the Manufacturer will at its sole election:

Replace the Product with a direct replacement or with a similar product deemed by the Manufacturer to perform substantially the same function as the original product; or
Elect to repair or facilitate the repair of any defective parts, free of any charge for the necessary parts and labor to complete the repair and restore the Product to its proper working condition. The manufacturer will also pay the shipping costs necessary to return the Product once the repair is complete; or
Issue a refund of the original purchase price by way of Product credit for Dongler branded items when currently available.

How to Obtain a Remedy Under this Limited Warranty

To obtain a remedy under this limited warranty, you must first contact the authorized Simply45® reseller from whom you purchased the Product or contact Simply45® directly by visiting the Returns section on the the GoSimplyConnect® website www.gosimplyconnect.com . In order to pursue any remedy under this limited warranty, you must possess an original, dated receipt as proof of purchase from an authorized Simply45® reseller or a receipt issued directly by Simply45® on direct purchases. If the Product is to be returned under this limited warranty, a return authorization number (RMA) issued from the Manufacturer will be required before you initiate the return process. You are responsible for any and all shipping costs to return the Product to the Manufacturer. If the Product is determined by the Manufacturer to be defective upon inspection, the Manufacturer will pay the shipping costs necessary to return the replacement Product to you or the Manufacturer will follow one of the three remedies indicated above.

If you purchased the Product from an authorized Simply45 reseller, please check with your reseller first before initiating the return process with the Manufacturer. The authorized reseller may be able to provide other remedies to you not available directly from the Manufacturer.

Any Product returned to Manufacturer that is determined not to be defective upon inspection by Manufacturer and determined by Manufacturer’s sole discretion not covered by the limited warranty; Product will not be returned to Customer unless Customer prepays the return shipping charges as determined by the Manufacturer.

Limited Warranty Exclusions

This limited warranty does not cover:

a) Cosmetic damages due to normal wear and tear or aging;

b) Deterioration due to normal wear and tear or aging

c) Damage caused by negligence, misuse, lack of maintenance, accident, abnormal operation, improper installation or use, or damage to any other items, devices, or systems;

d) Damages resulting from improper use, installation, unauthorized Manufacturer repair, alterations, neglect, abuse, or use with any non-Simply45 branded items;

e) Items attached to tools that are designed to wear out over time including trimming blade and cutting blades;

f) Damage caused to RJ45 modular plugs when not using Simply45 branded crimp tools designed for use with specific RJ45 modular plugs;

g) Loss or damages to Products incurred during shipping to the reseller or end user; or loss or damages to Products incurred during warranty return shipping back to reseller or Manufacturer;

h) Any defects if Products were purchased from an unauthorized reseller;

i) Any costs incurred by Customer or Reseller for loss of use due to any Product defects;

j) Damages caused by outside occurrences, such as lightning, fire, flood, acts of nature, or the like;

k) Damages caused by moisture, corrosion, power surges, electromagnetic interference (EMI), or radio frequency interference (RFI) shall not constitute a defect in materials or workmanship; or.

l) Any Products that are determined by the Manufacturer to be free from material defects preventing normal use of the Products.

Limitation of Liability

THE MAXIMUM LIABILITY OF THE MANUFACTURER UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE PRODUCT. MANUFACTURER SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS BASED ON ALL SUCH CLAIMS, WHETHER, FOR PRODUCT DEFECT, THE PRODUCT FAILED TO GIVE WARNING, OR OTHER THAN THE LIMITED WARRANTY OBLIGATIONS OF MANUFACTURER PROVIDED HEREIN.

THERE ARE NO WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, FOR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE, WHICH EXTEND BEYOND THE WARRANTY PROVIDED HEREIN. TO THE FULL EXTENT PERMITTED BY LAW, IN NO CASE SHALL THE MANUFACTURER BY LIABLE TO ANY INDIVIDUAL OR ENTITY FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOST PROFIT, LOST BUSINESS OPPORTUNITY, LOST REVENUES, OR ECONOMIC DAMAGE OF WHATEVER NATURE ARISING OUT OF OR RELATING IN ANY WAY TO THE PRODUCTS AND/OR BREACH OF THIS OR ANY OTHER WARRANTY OR CONDITION, EXPRESS OR IMPLIED, OR UPON ANY OTHER BASIS OF LIABILITY WHATSOEVER, EVEN IF THE LOSS OR DAMAGE IS CAUSED BY MANUFACTURER’S OWN NEGLIGENCE OR FAULT AND EVEN IF MANUFACTURER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES.

Governing Law

Any dispute arising from or relating to this limited warranty shall be in the state or federal courts located in Broward County Florida, USA, and both Resellers and Customers remit to the jurisdiction and venue of such courts and specifically waives any defense of Forum Non-Conveniens or lack of personal jurisdiction. This limited warranty shall be governed by and construed in accordance with the law of Florida USA without regard to its conflicts of law principles.
